Agreement

By creating an account or using The Audacity (“the Service”), operated by The Audacity (“we”, “us”), you agree to these Terms of Service. If you do not agree, please do not use the Service.

The Service

The Audacity is an AI-powered autobiography platform. You share memories through conversation, and the Service organizes them into a structured book. The Service includes a memory vault, chapter management, entity tracking, book reader, and data export tools.

Your account

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 13 years old to use the Service.
  • One person per account. Accounts are not transferable.

Your content

You own everything you create. All memories, stories, chapters, and other content you provide to the Service remain your intellectual property. We do not claim any ownership over your content.

By using the Service, you grant us a limited license to process, store, and display your content solely for the purpose of providing and improving the Service for you. This license ends when you delete your account.

You can export your complete book at any time. If you cancel your subscription or delete your account, you retain full ownership of your content.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use automated tools (bots, scrapers) to access the Service.
  • Submit content that infringes on the intellectual property rights of others.
  • Abuse rate limits or attempt to circumvent usage restrictions.

Subscriptions and payments

  • The Service offers free and paid subscription tiers.
  • Paid subscriptions are billed monthly through Stripe.
  • You can cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of your current billing period.
  • We do not offer refunds for partial months of service.
  • We may change pricing with 30 days' notice. Existing subscriptions remain at their current price until cancellation.
  • Free accounts include a 14-day trial of Storyteller-level features.

AI-generated content

The Service uses artificial intelligence (Anthropic's Claude) to process your conversations and generate book content. While we strive for accuracy:

  • AI-generated prose is a draft based on what you share. You should review and correct it.
  • The AI may occasionally misinterpret or misrepresent details. Always verify important facts.
  • The quality of your book depends on the details you provide.

Service availability

We aim to keep the Service available at all times, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We are not liable for any loss resulting from Service unavailability.

Data and backups

We maintain daily database backups and take reasonable measures to protect your data. However, we recommend regularly exporting your book as an additional precaution. We are not liable for data loss beyond the scope of our standard backup procedures.

Limitation of liability

To the maximum extent permitted by law, The Audacity and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of the Service.

Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

Termination

You may delete your account at any time from the Settings page. This permanently removes all your data.

We may suspend or terminate your account if you violate these terms, with notice when possible. In the event of termination, we will make reasonable efforts to allow you to export your data first.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

Dispute resolution

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in Jefferson County, Alabama.

No class actions. You agree that any dispute resolution will be conducted only on an individual basis, not as a class action, class arbitration, or other representative proceeding.

Small claims exception. Either party may bring an individual action in small claims court in Jefferson County, Alabama, if the claim qualifies.

Injunctive relief. Nothing in this section prevents either party from seeking injunctive or equitable relief in court for matters relating to intellectual property or unauthorized access.

Governing law

These terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law provisions.
